High Court

The High Court has supervisory jurisdiction and alteration of the results of all the Subordinate Courts, as well as jurisdiction to hear appeals from the Subordinate Courts, both civil and criminal cases.

High Court civil jurisdiction is not limited, and generally try cases that claim more than RM1000, apart from cases involving motor vehicle accidents, suffering, and disputes between landlord and tenant. This Court deals with cases relating to:
the validity or nullity of marriage (divorce) and the things his wife;

  • bankruptcy and matters relating to the winding;
  • child care;
  • giving valid statement of the will, the will, and letters of administration of estates;
  • injunction, specific performance (specific performance), or the cancellation of the contract;
  • validity of the individual.

The High Court has unlimited jurisdiction over all criminal cases other than matters involving Islamic law.

 

Cases heard by a single judge in the High Court, or by a judicial commissioner. While the judges of the High Court granted protection office (see the 1988 Malaysian constitutional crisis), the judicial commissioner appointed for a term of two years and did not receive the same protection under the Constitution.
